Welcome to Moth & Midden. These Terms & Conditions apply when you visit this website, purchase or pre-order a product, join the mailing list, access Moth & Midden content or otherwise use Moth & Midden’s website and services. By using this website or placing an order, you agree to these terms.

Moth & Midden is based in Aotearoa New Zealand.

Products and purchases

We do our best to describe, photograph and represent Moth & Midden products accurately. Colours may appear slightly different depending on your screen, device or settings, and small variations can occur between a printed product and its digital representation. Because some Moth & Midden products are independently produced in small print runs, there may also be minor variations in colour, texture, finish or packaging between individual items. These natural manufacturing variations are not necessarily faults. Nothing in these terms removes or limits any rights you may have under applicable consumer law.

The Moss Hag™ pre-order

The first edition of The Moss Hag™ Oracle Deck is being offered through a founding pre-sale. Production will begin once 175 decks have been pre-ordered. When you place a pre-order, payment is taken at the time of purchase and your order reserves a deck from the first production run. Because Moss Hag™ is being manufactured after the founding pre-sale target is reached, production and delivery will take longer than purchasing an item that is already in stock. Once production begins, customers who have pre-ordered will be kept updated as the deck moves through manufacturing, freight and fulfilment. Full details about the pre-order process, cancellations, refunds and what happens if the 175-deck target is not reached are available in the Pre-order & Refund Policy.

Prices

Unless otherwise stated, prices displayed on the Moth & Midden website are in New Zealand dollars (NZD). The price payable is the price displayed at checkout when you place your order. Shipping charges and any applicable taxes or other charges will be shown where available before you complete your purchase. For international customers, your bank, card provider or payment service may apply currency conversion fees, foreign transaction fees or other charges. These are outside Moth & Midden’s control.

Payment

Payment is processed through the payment services made available through the Moth & Midden checkout. Moth & Midden does not directly receive or store your complete payment card details. An order is not confirmed until payment has been successfully processed. If an obvious pricing, technical or product-listing error occurs, Moth & Midden may contact you before fulfilling the order to correct the issue. If the corrected price or terms are not acceptable to you, you will have the option to cancel the affected order and receive an appropriate refund.

Shipping and delivery

Information about shipping destinations, costs, international delivery, customs and fulfilment can be found on the Shipping page. Please make sure that the delivery information you provide at checkout is accurate and complete. If you notice an error after ordering, contact: info@mothandmidden.com We’ll do our best to correct your details before your order is dispatched, but changes may not be possible once an order has entered the delivery network. International orders may be subject to customs duties, import taxes or other charges imposed by the destination country. Unless otherwise stated at checkout, these charges are the responsibility of the recipient.

Refunds, cancellations and damaged products

Pre-order cancellations and refunds are covered by the Pre-order & Refund Policy. If your product arrives damaged, faulty, materially different from its description, or otherwise fails to meet rights available to you under applicable consumer law, please contact: info@mothandmidden.com Include your order number and photographs where relevant. We’ll work with you to determine the appropriate remedy, which may include replacement or refund depending on the circumstances. Nothing in these terms is intended to remove any consumer right or remedy that cannot legally be excluded.

Moss Hag™ and oracle guidance

The Moss Hag™ Oracle Deck, companion guidebook and other Moth & Midden products and content are created as tools for reflection, creativity, self-exploration and personal insight. They are not intended to predict the future or tell you what you must do.

Moth & Midden products and content are not substitutes for medical, psychological, legal, financial or other professional advice. Please use your own judgement and seek appropriate professional support when making decisions involving health, safety, finances, legal matters or other significant circumstances. You remain responsible for the decisions you make and for how you choose to interpret or use Moth & Midden material.

Intellectual property, copyright and trade marks

The creative work behind Moth & Midden™ and Moss Hag™ matters, and it is protected accordingly. Unless otherwise stated, the original writing, guidebook content, card text, sigils, layouts, product design, photographs, graphics, branding, logos and other original material appearing on this website or within Moth & Midden products are owned by, or used with permission by, Moth & Midden and are protected to the extent provided by applicable intellectual property law.

MOTH & MIDDEN™ and MOSS HAG™ are trade marks claimed by Moth & Midden. The ™ symbol indicates that Moth & Midden claims trade mark rights in these names. It does not represent that the trade marks have necessarily been formally registered in every country or jurisdiction. Where a trade mark becomes formally registered, the ® symbol may be used where that registration applies. Purchasing a Moth & Midden product gives you the right to personally use and enjoy that product.

It does not transfer ownership of the copyright, trade marks, artwork, writing, branding, product concepts or other intellectual property associated with it.

Unless you have prior written permission from Moth & Midden, you may not:

reproduce, copy or republish any portions of Moth & Midden content
reproduce or commercially use Moss Hag™ card artwork, writing, sigils or guidebook content
scan, digitise or distribute any portions of the deck or guidebook
create merchandise, products or other commercial works using Moth & Midden or Moss Hag™ artwork, writing, branding or intellectual property
use the names Moth & Midden™, Moss Hag™, associated logos or other branding in a way that suggests ownership, affiliation, sponsorship or endorsement
sell, sublicense or commercially distribute unauthorised physical or digital reproductions of Moth & Midden material
remove copyright, trade mark or ownership notices from Moth & Midden material
use Moth & Midden material for commercial AI training, dataset creation, model development or similar commercial machine-learning purposes without prior written permission

You are very welcome to photograph your Moss Hag™ deck, share individual cards you have drawn, discuss the deck, review it and share your own experience with it on social media. Please don’t present Moth & Midden material as your own, reproduce any parts of the deck or guidebook, or turn Moss Hag into merchandise and start a rival bog empire.

Nothing in this section is intended to prevent uses that are permitted by applicable copyright, trade mark or other intellectual property law.

User sharing and social media

If you tag Moth & Midden in a public social media post or send content to Moth & Midden for the purpose of being shared, we may ask your permission to repost it. We will not claim ownership of your original photographs, writing or other content simply because you tag or mention Moth & Midden. If you send material specifically for promotional use, any broader use will be subject to the permission you provide.

Website content

Reasonable care is taken to keep information on this website accurate and current. Occasionally, information may contain an error or become outdated. Moth & Midden may update product descriptions, prices, availability, policies or other website information when reasonably necessary. Where a material change affects an order that has already been placed, affected customers will be contacted where appropriate.

Acceptable use

Please don’t use this website in a way that:

breaks applicable law
interferes with the operation or security of the website
attempts to gain unauthorised access to the website or associated systems
introduces malicious software, code or other harmful material
uses Moth & Midden intellectual property without permission
impersonates another person or organisation
uses the website for fraudulent activity

Basically, be a decent human on the internet.

This website may contain links to third-party websites, social media platforms or services. Those sites operate under their own terms, privacy policies and practices. Moth & Midden is not responsible for websites or services that it does not own or control.

Privacy

Your privacy matters. Personal information collected through this website is handled in accordance with the Moth & Midden Privacy Policy. The Privacy Policy explains the information that may be collected, why it is collected, how it may be used, who it may be shared with, and your rights regarding your information.

Availability of the website

We’ll do our best to keep the Moth & Midden website available and functioning properly. However, uninterrupted access cannot be guaranteed. The website may occasionally become unavailable because of maintenance, technical problems, third-party service interruptions or circumstances outside Moth & Midden’s reasonable control.

Limitation of liability

Nothing in these terms excludes, restricts or modifies any right or remedy that cannot legally be excluded under applicable law. To the extent permitted by law, Moth & Midden is not responsible for indirect or consequential loss arising solely from use of this website or reliance on reflective, spiritual or creative content provided through Moth & Midden. Moth & Midden does not guarantee any particular personal, emotional, spiritual, financial or other outcome from using its products or content.

International customers

Moth & Midden is based in New Zealand but may sell and ship products internationally. If you purchase from outside New Zealand, you are responsible for complying with applicable local import requirements and for paying customs duties, taxes or other charges that are not collected through checkout. Nothing in these terms is intended to remove consumer protections that apply to you and cannot lawfully be excluded.

Changes to these terms

These Terms & Conditions may be updated from time to time as Moth & Midden grows, products or services change, or legal and operational requirements evolve. The current version will always be published on this page. Changes to these terms will not retrospectively remove rights relating to an order that has already been placed.

Governing law

These Terms & Conditions are governed by the laws of New Zealand, subject to any mandatory consumer protections that may apply in another jurisdiction.
